Who are We?

    Robert W. Avery received the degree of Juris Doctor in 1976, and  has been a practicing attorney for over 40 years, with offices in Ridgefield, New Jersey. During his years as an attorney he has served in various governmental posts including as the Borough Prosecutor for the Borough of Ridgefield, and as Judge of the Ridgefield Municipal Court for 15 years, between the years 1986 through 2000. After that time he has served on the Ridgefield Borough Council as both a Councilman and as Council President.

     In addition to his considerable Municipal Court trial practice, Bob has tried many significant cases involving divorce, estate matters, property issues, fraud, forgery and the recovery of property for its victims. He has also tried cases resulting in published decisions that are considered International Precedents involving the Hague Convention for the Civil Aspects of International Child Abduction. His successful trial results have been upheld in the New Jersey Appellate Division and Supreme Court, as well as the Third Circuit Court of Appeals and the United States Supreme Court. Bob’s trials have been widely covered by both legal journals and newspapers.

     His trials have included Municipal Court representation and trial work, tenancy, general commercial, contractual, foreclosure, personal injury, matrimonial and general equity matters. Litigation experience also includes matters involving forged documents (including deeds), fraud and the recovery of property for it’s victims. His work in the matrimonial area has included lengthy and complicated divorce and domestic violence trials involving multiple family members and widely disparite claims. In the field of construction claims, his trials have included claims by home buyers of grossly defective design and construction and outright fraud by builders. His Court appearances have been at all levels including the Municipal Courts, Superior Court Special Civil Part, Law Division, Chancery Division both Family Part and General Equity, Appellate Division and the Supreme Court, at the State Level, and the Federal District Court and Third Circuit Court of Appeals on the Federal level. Specialized cases include Delvoye v. Lee, 224 F.Supp.2d 843  (D.N.J. Sep 24, 2002) (NO. CIV. 02-769(FSH)), aff’d Delvoye v. Lee, 329 F.3d 330  (3rd Cir.(N.J.) May 20, 2003) (NO. 02-3943), cert den Delvoye v. Lee, 540 U.S. 967, 124 S.Ct. 436, 157 L.Ed.2d 312 (U.S. Oct 20, 2003), a matter involving an alleged child abduction from Belgium to the United States. The matter was tried to conclusion and favorably decided upon arguments of first impression to the Court. The case and appeal are widely cited as international precedents in the interpretation of the Hague Convention for the Civil Aspects of International Child Abduction and the International Child Abduction Remedies Act, 42 U.S.C. §§ 11601 et seq.


    John S. Avery received the degree of Juris Doctor in 2012, and has been involved in Municipal and Superior Court criminal trial matters, personal injury, commercial litigations, and matrimonial matters.  John focuses on Municipal Court and Criminal matters.  He is vigorously against authoritarianism and police abuse, which he sees as rampant.  

    While we must all obey and respect the the police and the tough services they provide, they too must operate within legal bounds.  Ackowledging that far more than can be tolerated, the police overstep their boundaries, and take advantage of people unfamiliar with the law. As such, John provides passionate defenses against unjust criminal and drug laws as well as any case where the police have overstepped.
